According to Article 27 of the Law on Residence 2020, the provisions on temporary residence registration are as follows:
– Citizens who come to reside at a lawful residence outside the commune-level administrative unit where they have registered their permanent residence for purposes such as working, studying, or other reasons for a period of 30 days or more must register for temporary residence.
– The maximum duration of temporary residence is 2 years and may be extended multiple times.
– Citizens are not allowed to register new temporary residence at the places specified in Article 23 of this Law.
Dossier and procedures for temporary residence registration:
The application for temporary residence registration includes:
- A Declaration of change in residence information; for registrants who are minors, the declaration must clearly state the consent of the father, mother, or guardian, unless written consent has already been provided.
- Documents and materials proving lawful residence as prescribed in Article 5 of Decree No. 154/2024/ND-CP, when requested by the residence registration authority:
Citizens shall provide information proving lawful residence to the residence registration authority when submitting the application for residence registration. The authority is responsible for retrieving this information from the electronic ID card, the electronic identification account on the national identification and authentication system via the National Identification Application, or from the National Population Database, the Residence Database, the Electronic Data Management Repository for organizations and individuals on the National Public Service Portal, ministerial- or provincial-level administrative procedure resolution information systems, or other national or specialized databases.
If the information proving lawful residence cannot be retrieved from the databases, information systems, or the national identification application, the residence registration authority is responsible for verifying and resolving the residence registration procedures. In such cases, citizens must provide a copy, photocopy, or electronic version of one of the documents or materials proving lawful residence, upon request from the residence registration authority.
Registration Procedure:
Step 1: Submit the application dossier:
In-person submission: The applicant submits the temporary residence registration dossier directly to the commune-level police office in the area where they intend to temporarily reside.
Online submission: The applicant submits the temporary residence registration dossier online through public service portals such as: the National Public Service Portal, the Ministry of Public Security’s Public Service Portal, the VNeID application, or other online public services as prescribed by law.
Application receiving hours: During office hours on working days from Monday to Friday and Saturday mornings (excluding public holidays and Tet holidays as prescribed by law).
Step 2: Upon receiving the temporary residence registration dossier, the residence registration authority shall verify the legality and contents of the dossier:
– If the dossier is complete and valid, it will be accepted and a Receipt of Application and Appointment for Result Return will be issued to the applicant.
– If the dossier meets the eligibility requirements but lacks certain components as prescribed by law, the applicant will be guided to supplement and complete the dossier, and a Supplement and Completion Guidance Slip will be issued.
– If the dossier does not meet the eligibility requirements, the application will be rejected and a Dossier Rejection Slip will be issued to the applicant.
Step 3: Individuals or organizations shall pay the residence registration fee in accordance with regulations.
Step 4: Based on the appointment date stated in the Receipt of Application and Appointment for Result Return, the applicant shall receive the notification of the result of the residence registration procedure (if any).
Processing time: Within 03 working days from the date the complete and valid dossier is received.
According to Decree No. 154/2024/ND-CP, documents and materials proving lawful residence for the purpose of temporary residence registration include:
– Documents certifying land use rights and ownership of property attached to land, issued by competent authorities over various periods in accordance with the laws on land and housing;
– Construction permits for residential houses or temporary construction permits for residential houses, where such permits are required under construction laws;
– Documents on the purchase of state-owned houses or documents on the revaluation, liquidation of houses attached to residential land owned by the state in accordance with the law;
– Contracts for the purchase of houses or documents proving the handover or receipt of houses from real estate developers who have invested in residential construction for sale;
– Documents related to the purchase, lease-purchase, donation, inheritance, capital contribution, or exchange of houses in accordance with land and housing laws;
– Documents on the granting or donation of gratitude houses, charitable houses, great solidarity houses, or the allocation of houses or land to individuals or households;
– Documents from courts or competent state agencies that legally recognize house ownership;
– Documents or materials proving the mortgage or pledge of lawful residential ownership;
– Contracts or documents regarding house rental, borrowing, or permission to stay temporarily;
– Documents or materials from owners of tourist accommodation establishments or other lodging facilities permitting individuals to register temporary residence at those facilities;

– Documents from agencies or organizations managing industrial parks, export processing zones, or economic zones allowing workers to register temporary residence at residences owned or managed by such agencies/organizations, in accordance with the law;
Note: Citizens must complete the temporary residence extension procedure within 15 days before the expiry date of their registered temporary residence.
